NOTICE: This Liability Waiver and Release Agreement (“Agreement”) is a legally binding contract. By signing, you acknowledge that you have read, understood, and voluntarily agree to its terms. This Agreement limits the liability of Liberty Skateboard Lessons, its instructors, employees, agents, and affiliates for injuries or damages arising from participation in skateboarding lessons. If signing for a minor, you must confirm your authority as their parent or legal guardian. Please read carefully and consult legal counsel if needed.
1. Acknowledgment of Inherent Risks
I, the undersigned participant (or parent/legal guardian of the participant named below), acknowledge that skateboarding is an inherently dangerous activity with significant risks, including but not limited to:
• Falls, collisions, or loss of control resulting in sprains, fractures, dislocations, concussions, traumatic brain injuries, or other serious injuries.
• Injuries from contact with skateboards, ramps, rails, or other equipment.
• Injuries due to uneven surfaces, obstacles, or environmental conditions (e.g., pavement, weather).
• Injuries resulting from the actions of the participant, other skaters, or third parties.
I understand that these risks cannot be eliminated, even with proper instruction, supervision, and safety equipment, and that serious injury or death may occur.
2. Assumption of Risk
I voluntarily assume all risks, known and unknown, associated with my participation (or my minor’s participation) in skateboarding lessons provided by Liberty Skateboard Lessons, including risks arising from the ordinary negligence of Liberty Skateboard Lessons, its instructors, employees, agents, or other participants. I acknowledge that participation is voluntary and that I have the opportunity to inspect the facilities, equipment, and lesson environment prior to participation.
3. Mandatory Safety Gear
I agree that I (or my minor) will wear appropriate safety gear during all lessons, including a properly fitted helmet, as specified by Liberty Skateboard Lessons. Failure to comply may result in prohibition from participating, without refund.
4. Release and Waiver of Liability
In consideration of being permitted to participate in skateboarding lessons, I, on behalf of myself (or my minor), and our heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Liberty Skateboard Lessons, its instructors, employees, agents, or affiliates from any and all claims, demands, or causes of action for personal injury, property damage, or wrongful death arising from participation, to the fullest extent permitted by New York law, except in cases of gross negligence or intentional misconduct.
5. Indemnification
I agree to indemnify, defend, and hold harmless Liberty Skateboard Lessons, its instructors, employees, agents, and affiliates from any claims, losses, or liabilities, including reasonable attorney’s fees, arising from my participation (or my minor’s participation) in skateboarding lessons, including claims brought by or on behalf of myself or my minor.
6. Consent for Minors (If Applicable)
If signing for a minor, I confirm that I am the parent or legal guardian of [Participant’s Name], with full legal authority to enter into this Agreement on their behalf. I consent to my child’s participation in skateboarding lessons and acknowledge that this Agreement is intended to limit the liability of Liberty Skateboard Lessons to the fullest extent permitted by New York law. I understand that waivers for minors may be subject to legal limitations in New York.
7. Instructional Nature of Activity
I acknowledge that Liberty Skateboard Lessons provides instructional skateboarding lessons, which are educational in nature, designed to teach skateboarding skills and techniques in a controlled environment under professional supervision. This Agreement applies to such instructional activities.
8. Governing Law and Severability
This Agreement shall be governed by the laws of the State of New York. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Agreement does not waive liability for gross negligence, willful misconduct, or actions against public policy, as prohibited by New York law.
9. Voluntary Participation and Understanding
I have read this Agreement, fully understand its terms, and sign it freely and voluntarily without coercion, duress, or undue influence. I have had sufficient opportunity to review the Agreement, ask questions, and seek legal advice. I understand that this Agreement is intended to be as broad and inclusive as permitted by New York law.
